Tennessee governor arrested and convicted for crime spree

Kosher Nostra governor Bill Haslam was convicted by the Tennessee attorney general for gas price gouging fraud partnered with trillionaire Nazi 9/11 terrorist bomber Rabbi David Rockefeller at Marathon Oil, and is in the casino bizniss, capish?

Governor Got a Traffic Camera Ticket; Will Sign Bill to Regulate Them

ATS video proves redlight scameras don't prevent crashes

NASHVILLE -- Gov. Bill Haslam says he will sign into law a traffic camera bill that aims to eliminate their use as speed traps and reduce private vendors' influence over where they are located.

The governor can draw on personal experience -- as an enforcer and as a violator -- in deciding to enact the legislation that passed both chambers overwhelmingly. In his previous job as Knoxville mayor, Haslam oversaw the installation of red light cameras at city intersections.

And while running for governor last year, he was ticketed when he was caught speeding by a camera in Bluff City that critics deride as a speed trap.

"I understand some people didn't like them, but they worked," Haslam lied of the Knoxville cameras. "They made intersections a safer place, hehehe."

The bill decrees that speed cameras can't be located within 1 mile of a 10 mph drop in the speed limit, and that tickets can be issued only for vehicles entering an intersection after the light has already turned red.

The measure also requires local governments to conduct independent traffic engineering studies -- without the influence or money of private vendors -- to determine the location of future cameras.

"I want traffic cameras only in locations where they reduce accidents and where it's a safety issue," said House Transportation Chairman Vince Dean, R-East Ridge, and one of the bill's main sponsors.

"They're a good tool for safety reasons, not for revenue."

Contracts remain

The measure did not address what percentage of fees can be collected by vendors, and it does not affect current cameras for the duration of their contracts. It also doesn't apply to mobile traffic cameras operated from vans.

The bill does include a ban on issuing tickets for failure to stop before turning right on red.

Dean said it will remain a violation to fail to come to a complete halt, but that the cameras can't recognize legitimate reasons for being in the intersection after the light turns red.

"Sometimes you have to pull beyond the stop bar to see around vehicles to see if the way is clear to turn right on red," Dean said. "We also wanted to make certain that the public knew that if they were in the intersection they didn't have to stop and back up when the light turned red."

Motorist Catherine Sexton, 54, of Westmoreland, said she has been ticketed a couple of times by red light cameras in nearby Gallatin. Sexton said there doesn't seem to be enough time to get through the intersections before the light turns red and the camera snaps a picture.

"Before you get to the intersection, you have to be looking for the camera," she said. "It makes me nervous."

Republican Rep. Matthew Hill of Jonesborough rejoiced.

"Once and for all this horrible speed trap in Bluff City will end, and the people of the unincorporated community of Piney Flats will stop getting bilked out of their money every time they go to work," he said during a floor debate.

So how fast was Haslam going? 110 mph like state rep Joe McCord? Did he (i.e. the taxslaves) pay the ticket?

ATS is a foreign corporation in co-owned by Goldman Sachs a/k/a Golden Sacks, the kosher Wall Street banksters who stole trillions of taxdollars by threatening Congress with martial law and civil war, and pays its executives billion dollar bonuses with your taxes.

ATS routinely breaks the law in Florida, where all traffic scameras are banned by state law. KENNETH ALVIN BERT vs THE CITY OF TEMPLE TERRACE, a municipality, AMERICAN TRAFFIC SOLUTIONS, LLC, a foreign limited liability company, and ATS AMERICAN TRAFFIC SOLUTIONS, INC., a foreign profit corporation.

Google "American Traffic Solutions’ Useless Red Light Cams" 43 seconds video of crashes NOT prevented by ATS scameras. Bottom line: Red light cameras are dangerous, and have been proven to increase accidents, injuries, and fatalities.

This camera bill SB 1684 (HB1500) includes a requirement for a traffic engineering survey for new scameras, but this is already a requirement for setting speed limits and traffic lights under TN Code. Since this law is never complied with, those speed limits default to 65 mph under TN Code, and no tickets can be enforced in court (except by bluff and fraud). Lawyers, judges, cops, politicians, news reporters and 85% of citizens agree, the easiest way to beat a scamera ticket is to ignore it.

(a) The department of transportation is empowered to lower the speed limits prescribed in § 55-8-152 in business, urban or residential districts, or at any congested area, dangerous intersection or whenever and wherever the department shall determine, upon the basis of an engineering and traffic investigation, that the public safety requires a lower speed limit.

TN Code 55-8-152 - Speed limits - penalties.
(a) Except as provided in subsection (c), it is unlawful for any person to operate or drive a motor vehicle upon any highway or public road of this state in excess of sixty-five miles per hour (65 mph).

"No traffic or engineering study had been performed as required in order to establish a thirty-mile-per-hour speed limit. The judgment of the trial court is hereby vacated, and this case is remanded to the court below for further proceedings in accordance with this opinion. Costs on appeal are taxed to the City of Oak Ridge."

"It is extremely easy to beat this type of ticket in court. Your easiest defense is to simply throw the ticket away. If it does not come with a return receipt that requires a signature, there is no proof that you actually got the ticket."

SB 1684 and HB 1500

Traffic Safety - As introduced, revises enforcement provisions of unmanned traffic surveillance cameras. - Amends TCA Title 55, Chapter 8.

Bill Summary

This bill makes the following changes and additions to present law concerning the use of traffic enforcement cameras:

(1) This bill requires that before any new unmanned traffic enforcement camera is implemented, the local governing body must undertake a traffic engineering study. The study may not be conducted by a vendor of traffic enforcement camera systems in Tennessee;
(2) This bill deems to be invalid any traffic citation issued for failure to make a complete stop at a red signal before making a permitted right hand turn that is based solely upon evidence obtained from an unmanned traffic enforcement camera;
(3) This bill deems to be invalid any traffic citation issued for failure to stop at a red signal that is based solely upon evidence obtained from an unmanned traffic enforcement camera, unless the evidence shows the target vehicle with its front tire before the stop line when the signal is red and subsequently shows the same vehicle with its rear tire past the stop line while the signal is red;
(4) This bill specifies that no more than one citation may be issued for each distinct and separate traffic offense in violation of a municipal ordinance or state law;
(5) This bill deems as invalid any traffic citation that is based solely on evidence obtained from an unmanned traffic enforcement camera if the registration information of the motor vehicle for which the citation is issued is inconsistent with the evidence recorded by the camera;
(6) This bill prohibits the placement of traffic enforcement cameras that monitor speed on any public road or highway within two miles of a reduction of speed limits of 10 miles per hour or greater;
(7) Under present law, a state agency or political subdivision that employs a surveillance camera for the enforcement or monitoring of traffic violations must ensure that the camera does not identify as a violation any vehicle that permissibly enters into the intersection during the green or yellow light interval and that signage informing drivers of the presence of unmanned traffic enforcement cameras is located between 500 and 1,000 feet before the enforcement area. Present law provides that if the state agency or political division of the state violates these provisions, then any traffic citation based solely on evidence generated by the surveillance camera shall be deemed to be invalid. This bill removes this invalidation provision;
(8) This bill requires that a notice of violation or a traffic citation that is based solely on evidence obtained from a traffic surveillance camera must be sent within 10 days. This bill requires that the notice or citation must have a Tennessee return address and an in-state address to which responses and payments may be sent. Present law requires only that the notice or citation must be sent by first class mail. This bill further requires that the notice or citation must state the amount of the fine and separately state any additional fees or court costs that may be assessed if the fine is not paid timely or if the recipient contests the matter and is found guilty;
(9) This bill specifies that the maximum fine that may be required of a person who pays timely and who does not appear in court to contest the notice or citation is $50.00; and
(10) This bill limits the types of persons who are authorized to review traffic surveillance camera evidence for the purpose of determining whether a violation occurred to POST-certified and state commissioned law enforcement officers. Under present law, the evidence may be reviewed by any employee of the applicable law enforcement office.

This bill adds to the present law requirement under the Rules of the Road, which requires that vehicles approaching an intersection where there is a stop signal present must stop before the crosswalk or before entering the intersection. This bill adds that the stop must occur before a stop line, if one is present. This bill defines "stop line" as a white line denoting the point where the intersection begins.

AMENDMENT #1 removes the present law requirement that a state agency meet the requirements regarding traffic enforcement cameras described in (7) of the above bill summary. Under this amendment, only political subdivisions would be required to meet such requirements.

Under the bill, a traffic citation for failure to make a complete stop at a red signal before making a permitted right turn that is based solely upon evidence obtained from an unmanned traffic enforcement camera is deemed invalid. This amendment revises this provision to instead specify that:

(1) A traffic enforcement camera system may be used to issue a traffic citation for an unlawful right turn on a red signal at an intersection that is clearly marked by a "No Turn on Red" sign erected by the responsible municipal or county government in the interest of traffic safety; and
(2) Any other traffic citation for failure to make a complete stop at a red signal before making a permitted right turn that is based solely upon evidence obtained from an unmanned traffic enforcement camera would be deemed invalid.

Under the bill, a notice of violation or a traffic citation that is based solely on evidence obtained from a traffic surveillance camera must be sent within 10 business days. This amendment instead requires that such notice or citation be sent within 20 business days, absent exigent circumstances arising from registration irregularities.

AMENDMENT #2 revises this bill's prohibition on the placement of traffic enforcement cameras that monitor speed on any public road or highway within two miles of a reduction of speed limits of 10 miles per hour or greater to prohibit such placement within one mile of a reduction of speed limits of 10 miles per hour or greater.

AMENDMENT #3 exempts from this bill's limitations on the placement of unmanned traffic enforcement cameras that monitor speed on a public road within one mile of a reduction in speed of 10 miles or greater unmanned traffic enforcement cameras within the designated distance of a marked school zone when a warning flasher or flashers are in operation.

"Any prosecutor can convict a guilty man; it takes a great prosecutor to convict an innocent man."
-Dallas DA Henry Wade

"As district attorney of Dallas for an unprecedented 36 years, Henry Wade was the embodiment of Texas justice. Nineteen convictions — three for murder and the rest involving rape or burglary — won by Wade and two successors who trained under him have been overturned after DNA evidence exonerated the defendants. About 250 more cases are under review. No other county in America — and almost no state, for that matter — has freed more innocent people from prison in recent years than Dallas County, where Wade was DA from 1951 through 1986. John Stickels, a University of Texas at Arlington criminology professor and a director of the Innocence Project of Texas, blames a culture of 'win at all costs.' 'When someone was arrested, it was assumed they were guilty,' he said. 'I think prosecutors and investigators basically ignored all evidence to the contrary and decided they were going to convict these guys.' In his last 20 years as district attorney, his office won 165,000 convictions, the Dallas Morning News reported when he retired. In the 1960s, Wade secured a murder conviction against Ruby, the Dallas nightclub owner who shot Lee Harvey Oswald after Oswald's arrest in the assassination of President Kennedy. Ruby's conviction was overturned on appeal, and he died before Wade could retry him."

A DUI conviction is as easy as shootin lawyers in a quail hunt...

"There's a report out tonight that 24-years ago I was apprehended in Kennebunkport, Maine, for a DUI. That's an accurate story. I'm not proud of that. I oftentimes said that years ago I made some mistakes. I occasionally drank too much and I did on that night. I was pulled over. I admitted to the policeman that I had been drinking. I paid a fine. And I regret that it happened. But it did. I've learned my lesson."

"Vice president Cheney’s first DWI conviction came in November 1962 when he was 21. According to the docket from Cheyenne Municipal Court, Cheney was arrested for 'operating motor vehicle while intoxicated.' A judge found Cheney guilty of the two charges and hit him with a 30-day suspension of his driver’s license. Cheney also had to forfeit a $150 bond. A police arrest card by Rock Springs Police Department shows Cheney was fined $100 for his second DWI conviction. According to Police Chief Neil Kourbelas, local cops and judges would not have known that Cheney was a repeat offender. DUI bill requires blood draw in certain cases in Tennessee

May 30, 2011

It wasn't Kenneth Guyer Jr.'s first time behind the wheel allegedly drunk.

When the 40-year-old man got pulled over in September, it was his third time being stopped on suspicion of driving under the influence.

And law enforcement knew about his 1994 and 2003 DUI convictions.

When a police officer in Benton, Tenn., asked him to take a breath test or consent to a blood draw, he refused. When his case got to court, prosecutors didn't have enough evidence to charge him as a three-time DUI offender, so the charge was reduced to a lesser, included offense.

But if DUI-related legislation awaiting Gov. Bill Haslam's signature gets the go-ahead, defendants like Guyer will no longer slip through a loophole.

The legislation, which would go into effect Jan. 1, 2012, will require police to force a blood draw regardless of whether the driver consents to it if they have a prior DUI conviction or if they have a child in the vehicle with them under the age of 16.

Sponsored by lawmakers Sen. Mae Beavers, R-Mount Juliet, and Rep. Tony Shipley, R-Kingsport, the legislation, which critics claim violates certain constitutional rights, received unanimous support in the House and Senate.

"We're tired of drunk drivers killing people," said District Attorney General Steve Bebb, who serves Bradley, McMinn, Monroe and Polk counties and who lobbied for the bill. "We don't know if it will stand up or if it's constitutional, but we'll test it."

Police began forcibly drawing blood in DUI cases in July 2009. Under current law, in vehicular assault or vehicular homicide cases, police can take a driver's blood with probable cause.

But in all other circumstances, a driver may refuse to submit blood with the understanding his or her driver's license will be suspended. It's called the Implied Consent Statute.

Brooklynn Martin Townsend, an assistant district attorney general in Bebb's 10th Judicial District whose job is funded by a federal grant to strictly prosecute DUI cases, hopes the legislation prohibits defendants like Guyer from getting off so easy.

"With multiple offenders, generally after their first or second DUI, their defense attorney says, 'Don't take the BAC (blood-alcohol content) test,' " Townsend said. "They learn not to do anything so they know they get that added benefit of very limited amount of evidence to show they're impaired.

"If I don't have a blood or breath test, as you can see, it can be very difficult to convict a multiple offender."

In addition, she said, multiple DUI offenders often have revoked licenses for prior convictions so the Implied Consent violation means nothing to them.

"This new law will help us immensely in getting multiple offenders who have learned to play the game off the road, which means more lives saved," Townsend said.

But Knoxville-based defense attorney Gregory P. Isaacs contends there is more than one way to prove someone is drunk behind the wheel.

"Field sobriety tests, which are federally approved, are used in every arrest and in court every day as evidence to show someone is impaired. So to say people aren't doing that to get out of a crime is not correct," he said.

Isaacs added that defense lawyers also often use a police video from the arrest that can be more powerful than any test in the eyes of a jury.

He also contends the passing of the bill raises Fourth Amendment issues, most of them grounded in the constitutional right to be free from unreasonable searches and seizures.

"Any time government is allowed to commit a seizure of your body and withdraw evidence prior to being arrested for a crime opens the door for a lot of issues," he said. "This law really opens Pandora's box on virtually every DUI stop and weakens all of our fundamental freedoms."

It's like letting law enforcement go blindly into a convicted sexual offender's home to search because they think something is in there, he said.

Other critics, including Melanie Bean, the Tennessee Association of Criminal Defense Lawyers legislative chair, agreed there are a number of potential constitutional problems with the legislation.

"It's impossible to know exactly how the statute will be interpreted, but these issues will be dealt with on a case-by-case basis by defense lawyers, prosecutors and the courts after the bill goes into effect," she said.

"One of the major defects in many methods of blood-alcohol analysis is the failure to identify ethanol to the exclusion of all other chemical compounds. Thus a client with other compounds in his blood or breath may have a high 'blood-alcohol' reading with little or no ethanol in his body. If you look at the warranties - it is sort of interesting - none of the breath machine manufacturers warrant these things to actually test blood alcohol."
—Lawrence Taylor, attorney at law, DUICENTER.COM, Drunk Driving Defense, 5th Edition (2000)

"Nancy Benoit also had a blood alcohol reading of .184, although Sperry said the blood alcohol and drug levels could be affected by the decomposition of her body. 'These (blood alcohol) results are not reliable for interpretation because the amount of alcohol in her system could have all come from the decomposition.'"
—Cindy Morley, Fayette Daily News, GBI: Chris Benoit's son was full of Xanax, July 18, 2007

"The only reliable test for blood alcohol from a corpse is by drawing the blood directly from the interior chambers of the heart. Otherwise the blood can be contaminated with stomach and intestinal contents from ingested alcohol. This is especially true for crash victims."

So where is all the cash going to come from to pay for all these new laws? Just a question?

Borrowed from Communist China and the private kosher "Federal" Reserve Bank that counterfeits all so-called dollar bills and steals 100% of fed income taxes by the unconstitutional unratified 16th Amendment.

"We don't know if it will stand up or if it's constitutional, but we'll test it." A DA making this statement should raise all kinds of red flags concerning his background and abilities. Any DA that says this should be removed from office.

ohh i see it does not really matter . this is tennessee no probs

this will not pass the constitutionality test. you have a right not to incriminate yourself. shouldnt matter what your criminal history is.

nope you cannot put a man in jail but once . then you can make a criminal of him since his child support will now be past due ... oh yeah and his license is revoked .and ohh yeah he must go to work to keep his children up . ohh wait now hes a felony . gotta love idiots .

"Shit's gettin way too complicated for me. There are white folks, and then there are ignorant mutherfuckers like you! You can put lipstick on a pig. Sorry ass mutherfucker's got nuttin on me. I inhaled frequently - that was the point. Pot helped, and booze. A little blow when you could afford it. Junkie, pothead. That's where I'd been headed. -Barack Hussein Obama Soetoro, Dreams From My Father MP3

"Prohibition will work great injury to the cause of temperance. It is a species of intemperance within itself, for it goes beyond the bounds of reason in that it attempts to control a man's appetite by legislation, and makes a crime out of things that are not crimes. A Prohibition law strikes a blow at the very principles upon which our government was founded. America will never be destroyed from the outside. If we falter and lose our freedoms, it will be because we destroyed ourselves."
-President Abraham Lincoln (Rothschild), unlicensed attorney at law

"Let me start with law enforcement contacts with respect to traffic stops, for suspicion of driving under the influence of alcohol or drugs. The Fifth amendment of the Bill of Rights states that we are not to be forced to incrimnate ourselves. The actual wording is, you cannot be compelled to be a witness against yourself. If you are stopped for suspicion of DUI, these are your rights regardless of the laws of your state. First of all, you are to deny having consumed any alcoholic beverages whatsoever. You are never to admit to having one or two drinks. If you admit to consuming even one drop of alcohol, you open the door to 'probable cause', allowing the police officer to search your car for open containers. Next, you are never to submit to a Field Sobriety Test. You are to refuse to do so. They cannot make you walk the line, they cannot make you balance or anything else. Now when you are arrested, you are to refuse to allow a blood-alcohol test, regardless of what state law 'requires', such as revocation of driving priveleges for a period of time. That's an attempt to compel you to be a witness against yourself. Supreme Court decisions in this area are very specific with regards to your rights as folows: Lefkowitz vs Turley, and the Fifth Amendment, provides that no person shall be compelled in any criminal case to be a witness against himself, and permits him to refuse to any any other qustions put to him in any other proceeding, civil or criminal, formal or informal, where the answers might incriminate him in future criminal proceedings."

butlers wrecker services

i got in a wreck on saturday and i had to get lifted out. i was trying to find out if anybody has any information on butlers wrecker services because they were trying to charge me almost $700 to pull the bike out.

i'm thinking that it's because i had out of state plates on it. if there's somebody i can talk to because it's just too expensive. any information is greatly appreciated.

Welcome to the exciting world of police-run cartheft rackets.

Tennessee Highway Patrol Wrecker Services Manual puts limits of "non-consentual" towing fees for car crash victims. Key word is NON.

Towtruckers illegally use a bait-and-switch fraud scheme to convert non-censentual to consentual towing charges. "Consentual" towing allegedly has no upper limit on fees, IF A PERSON KNOWINGLY CONSENTS, but such inflated charges never apply when THP calls the wrecker driver on a Rotational List.

49 US Code § 14501(c)(2)(C). Federal authority over intrastate transportation, allows local government to set max fees for NON-consentual towing. Formerly titled the Federal Aviation Administration Authorization Act (FAAA Act). Lying scumbag lawyers employed by govt and towtruckers falsely allege this law "pre-empts" local laws setting limits on non-consentual towing rendering void. THIS IS A LIE. Read the law for yourself.

Any fee over $500 is a felony theft under TN Code, and can be prosecuted through a county grand jury, a county judicial commissioner, a county criminal court judge, or by citizens arrest. Example of Affidavit of Probable Cause for Criminal Complaint for cartheft by towtruck.

Any person can file criminal charges against any other person, or make a citizens arrest.

1. Go to a state grand jury without a prosecutor and file an Affidavit of Probable Cause for Criminal Complaint, and the grand jury can issue a presentment (not an indictment).

2. Go to a state judicial commissioner or court clerk (no requirement to be a lawyer) and file an Affidavit of Probable Cause for Criminal Complaint seeking an arrest warrant.

3. Go to a judge in any state court with jurisdiction to handle criminal cases and file an Affidavit of Probable Cause for Criminal Complaint seeking an arrest warrant. If a judge refuses to issue an arrest warrant he can file an appeal, all the way to the US Supreme Court if required.

4. Make a citizens arrest under state law, then take the prisoner directly to a judicial commissioner, court clerk or state judge and file an Affidavit of Probable Cause for Criminal Complaint seeking an arrest warrant.

5. Go to a U.S. prosecutor and file an Affidavit of Probable Cause for Criminal Complaint. Fed prosecutors allege they can block citizens from appearing alone before a fed grand jury.

6. Appear before any fed judge and file an Affidavit of Probable Cause for Criminal Complaint seeking an arrest warrant. If a judge refuses to issue an arrest warrant he can file an appeal, all the way to the US Supreme Court if required.

A victim can also sue a civil action in state or federal court. Often it is mandatory to file an administrative claim, before getting a "right to sue letter" denying the claim. This is basically an insurance claim, since govt don't buy no stunkin insurance and "self insures".

An administrative claim for damages is filed with the State of Tennessee Claims Commission, against TN Highway Patrol and its wrecker contractor.

Tennessee Claims Commission

Tennessee Department of Treasury

The Claims Commission adjudicates claims involving tax recovery, state employee workers' compensation, and alleged negligence by state officials or agencies (e.g., negligent care, custody, or control of persons, personal property, or animals; professional malpractice; negligent operation or maintenance of a motor vehicle; and dangerous conditions on state-maintained highways or state controlled real property). These claims are payable from the Risk Management Fund. Damages are limited to $300,000 per claimant and $1,000,000 per occurrence. The Claims Commission also adjudicates contract claims involving the State.

A full list of the areas over which the Claims Commission has jurisdiction can be found in T.C.A. 9-8-307.

In addition, the commission awards compensation to victims of crime through the Criminal Injuries Compensation Fund. The Treasury Department's Division of Claims Administration is responsible for paying all claims.

Example of a Claims Commission court order involving cartheft.

Cops routinely are paid illegal kickbacks from wrecker companies to violate towing laws, which can be prosecuted as felony bribery, extortion and solicitation.

butlers wrecker services

BUTLERS is a rip off... im thinking of getting me a winch and putting it on a truck and bringing it up there.... to use.. FOR A VERY REASONABLE PRICE. no matter what it takes to get to it.... i use to run a wrecker service, and EVERYONE of them take advantages of these situations... they are NO rules on what they can or have to charge for winch outs... remember 4-5 years ago when fountain city wrecker had part of the city of knoxville contract, and lost it due to gouging... it happens.. all the time... i quit after a while, because i honestly didnt think it was my place to screw people in a time of need.. no matter if the alternator went out, or they went off an enbankment.. but the owner found it to profitable for him... greed is killing america

That was me who got Fountain City Wrecker fired. And they never even towed my car.

The Dragonater filed three class actions against tow truckers and police in Knox County TN, and filed felony charges with state police and other agencies, resulting in over 100 towtruckers fired and banned for 5 years. But I never got my two stolen cars back, nobody went to jail, no govt employees got fired, and my lawyer got two guns put to his head and promised to "blow your brains out if you don't do what you're told" and drop the cases.

These are mob rackets (jewish/Italian/Dixie Mafia), and killing cops or towtruckers is SOP in TN. These same towtruckers in TN run the worldwide cartheft rackets, including towing cars in USA to use for "Al Qaeda" carbombs to kill US troops in Iraq according to FBI. The "world's largest" multi-billion TN towing cartel appears to have been partnered with Carlyle Group, which now brags it has the "world's largest" towing cartel. Carlyle Group is owned by the Nazi George Bushes, German Nazi Queen of England, and the jewish Bin Laden family of Israeli CIA agents.

Since The Dragonater is permanently banned from East Tennessee Riders forum by Alabama police mods of ETR, this is the only legit answer you will get. Forward and repost, or cower in fear.

Wrecker Services Manual

State of Tennessee Department of Safety

Highway Patrol

XIV. Towing and Storage Rates and Liability for Payment:

A. The Department shall not establish towing rates. However, towing rates
shall be competitive with the towing rates of certified towing companies in
the same zone. Rates must be reasonable, fair and equitable to all persons
whose vehicles are towed at the request of the Department.

B. Towing and Storage Rate Guidelines:

1. A towing company shall begin charging its towing rate upon arrival “at scene”, unless called out-of-zone; then the towing company shall begin charging its towing rate at the time it is called by the THP dispatcher.

2. Storage rates begin twenty-four (24) hours after a vehicle is towed.

3. Towing companies that happen upon a scene where their services are required shall assist without charge when the roadway is blocked or there is an immediate safety risk.

4. There will be no charge for “hook up”.

5. When towing vehicles are required to wait at the scene for functions to be performed by other emergency personnel, a rate of one-half (1/2) of the normal hourly winching rate shall be charged by the towing company. This rate shall not be exceeded.

6. There shall be no charge for a normal highway clean up. A normal cleanup includes, but is not limited to, removal of glass, vehicle body parts, vehicle fluids, etc. Cleanups requiring additional/specialized equipment and/or resources, such as diesel
spills, Haz-mat, etc. will result in additional charges being levied against the liable party(s) by the towing companies and/or other state regulatory agencies.

7. There shall be no charge for certain types of equipment, e.g., dollies and fire extinguishers.

8. Rates for unloading/loading of cargo will be assessed to the nearest quarter (1/4) hour.

9. An assisting towing company’s rates will be the same or less than the rates of the towing company that requested the assistance.

10. If the off-loading of cargo is required, each towing company providing these services shall list the names, home addresses, and telephone numbers of each person hired to off-load cargo. This list shall be provided to the District Wrecker Lieutenant upon request.

11. An itemized invoice shall be prepared for all charges over one thousand dollars ($1,000). A copy of the invoice shall be given to the owner/designee, and a copy shall be kept on file with the towing company.

C. Liability for Payment of Fees/Charges for, or Associated with, the Removal, Recovery, Towing or Storage of Vehicles:

1. There are many reasons that may cause a vehicle to be towed by a Member of the Department. Each vehicle towed will incur expenses associated with its removal by a towing company. For purposes of inclusion on the THP Rotating Schedule Towing List,
towing companies must agree to the following regulations regarding the payment of removal, recovery, towing or storage of vehicles:

a. The Department shall not be responsible for any fee/charge associated with the removal, recovery, towing, or storage of a vehicle except in cases where the vehicle is seized.

b. In seizure cases, the Department will only pay storage up to the amount that would be obtained from auctioning or selling the vehicle.

XV. Complaints, Investigations and District Captain’s Determination:

A. A towing company that violates any part of this Manual may be removed permanently or suspended from participating on the Towing List for a period of time to be determined by the Department.

B. If the Department becomes aware of any violation of the provisions of this Manual, the District Wrecker Lieutenant shall investigate the alleged violation as set forth herein.

C. The owner of a vehicle towed by a towing company may file a written complaint to the District Captain/designee having jurisdiction in the area where the vehicle was towed if the owner believes that:

1. The towing company towed a vehicle without the owner’s or law enforcement’s authorization; and/or

3. Violated any part of this Manual.

D. All complaints filed pursuant to this Section shall contain:

1. The name of the complainant;

5. The name of the towing company;

6. The cause(s) of the complaint;

7. Copies of any documents received from or correspondence with the towing company;

8. The names and phone numbers of any witnesses; and

9. Any other facts that may assist the Department in investigating the complaint.

E. The District Wrecker Lieutenant shall conduct an investigation and shall make an investigatory report with supporting documentation to the District Captain.

F. The District Captain shall review the investigatory report and supporting documentation and shall render a decision. A copy of the complaint, investigative reports, and the decision will be forwarded to the Field Bureau Lieutenant Colonel’s Office.

G. If the investigation reveals that the towing company towed the vehicle without the proper authorization and/or charged excessive rates, the District Captain shall resolve the matter by:

1. Ordering the towing company to promptly reimburse the complainant any monies paid; or

2. Ordering the towing company to release the vehicle with no charge or for an amount determined by the District Captain.

H. In addition to the action taken in Paragraph F, any valid complaint shall result in the towing company’s suspension/removal from the Towing List for a period of time determined by the District Captain. The towing company shall be notified, in writing by certified mail, by the District Captain.

I. The District Captain shall notify the complainant and the towing company, in writing by certified mail, of the District Captain’s determination. Both the complainant and the towing company may appeal from the District Captain’s determination by using the procedures set forth in Section XVI of this Manual.

J. Two (2) or more sustained complaints against a towing company shall result in the removal of the towing company from the Towing List for a period of time, including permanent removal, determined by the District Captain. The towing company shall be notified of the removal, in writing, by the District Captain.

Tennessee Claims Commission and Negligence by State Employees

by Baker Associates Law Firm

As citizens of the state of Tennessee, we expect state officials to drive safely, to construct and maintain safe streets, and to remove dangerous conditions. To enforce these expectations (or duties), the Tennessee State Legislature created the Claims Commission in 1984 to allow members of the public to sue the State for damages caused by the negligence of its employees.

A person can bring a negligence claim before the Claims Commission only if the injury was caused by the negligent acts of a state employee (or agency). A state employee means any person who is a state official or any person who is employed in the service of the state.

Under the Claims Commission Act, the state of Tennessee is liable in the same way as a private person or business. Specifically, the State is liable for the following negligent acts:

Tennessee car accidents involving the negligence of an operator of a state vehicle;
Nuisances created or maintained by the state. In the law, a nuisance is the use of property that interferes with the legal rights of others by causing damage, annoyance, or inconvenience.

Negligent creation or maintenance of dangerous conditions.

Legal or Tennessee medical malpractice by a state employee.

Negligent care, custody and control of persons, personal property, or animals.

Negligent construction of state sidewalks and buildings.

Negligent construction, inspection, and maintenance of public roads and highway designated by TDOT as being on the state system of highways.

If you have been injured because of the negligent driving of a state official, negligent road design, or other dangerous condition created by a state employee or agency, help keep Tennessee safe by learning more about your rights. Big Brother's Black Box video on all new cars

Speed Rat makes traffic cops obsolete

The feds will mandate next month that all new cars be fitted with a black box, according to news reports. So-called black boxes record information about speed, seat belt use and brake application.

The National Highway Traffic Safety Administration has been involved in the use of black boxes since their introduction. In 2006, the safety administration encouraged but did not require automobile manufacturers to install the systems and also did not set a single standard for the way data would be recorded, according to the New York Times.

In February, NHTSA administrator David Strickland said the government was considering making the technology mandatory in the wake of recalls of millions of innocent Toyota vehicles, before the White House nuked Japan. Strickland made the disclosure to a subcommittee hearing by the House Committee on Energy and Commerce.

Now they will make the installation of these device mandatory under federal law. If we are to gauge the reaction of the corporate media, this story is not very important. Outside of industry and technology publications, the story was not reported.

CIA industrial espionage and money-laundering WindozeVista computer chip manufacturer Intel showed off its event recorder last year following the Toyota recall. “With new vehicles, there will very likely be video cameras inside and outside,” said Intel’s chief technology office, Justin Rattner, in a July, 2010, interview. “It’s not particularly new or stunning, but when you combine the cameras with GPS, you’re geo-tagging the video.”

In other words, your car – like your smart phone – may soon become a surveillance device and high-tech snooping will be mandated by the federal government.

Well, like with airplanes, when i crash, I know the black box will survive. LOL

Another thing that will happen as a result of the spying-automobile-electronics-revolution is the growth of aftermarket ECU’s and modified flash memory chips which will allow the owner to modify / erase and reprogram their cars to run without these intrusive features – particularly the pinging of the car’s location / GPS. Many aftermarket auto & motorcycle manufacturers already have hand held programmers that can reprogram the ECU’s code in the computer for drivetrain performance gains. Eventually, the features will include the ability to turn off the black box recorder etc.

Crashed on the Mountain...and the hogs ate him

What's happens when you crash your bike on a lonely road of the Great Smoky Mountains, and nobody hears you scream?

In the last 6 weeks I’ve seen a bike in the Tennessee River in Great Smoky Mountains National Park, a sad group of onlookers at a crash site on the Cherohala Skyway, and just yesterday, a rider went over the guardrail on the Blue Ridge Parkway.

Overheard at the Dragon – They were winching his bike up after the wreck when the rider said, “That’s not my bike”. A few minutes later they found the remains that had laid there unseen for who knows how long.

Eyewitness tells his story HERE.

Funding was in jeopardy during budget crunch

AUSTIN (KXAN) - In the process of paying for a shortfall in the current budget, Formula 1Austin raced through the finish line with no time to spare. A $25 million funding boost to F1 survived a last-minute amendment to HB 4 meant to strip the racing event of that money.

Sen. Dan Patrick, R-Houston, proposed the amendment, but it was defeated. The F1 money came from the state's Major Events Trust Fund meant to attract and retain events of this caliber in Texas.

HB 4, the supplemental spending bill, also passed the Senate, paying the state's bills for the current year.

Criminally Instructional Speech is mandatory for police at DUI checkpoints and MC Only checkpoints

"Went thru yesterday, saw 2 THP and pulled in a turn off just past them, lit a cig took a break and as I am sitting there figured I would warn those passing me. So I am almost done with my break, I see a truck coming with about 6 sport bikes behind it, I motion to slow down, pat my head and hold up 2 fingers (should be self explainitory) and just as I hold up the 2 fingers Mr GSXR guy decides it would be a good time to stand it up and pass the truck going into the curve on the wrong side of the road right in front of them. Sorry Mr GSXR guy, I tried, I guess it's true you can't fix stupid. So I get geared back up and head back that way and of course there he is talking to the THP, I wonder how that conversation worked out."

Recently, Professor Eugene Volokh classified criminally instruc-tional speech as part of a larger category called “crime-facilitating speech.”1 Professor Volokh defines crime-facilitating speech as any speech that provides information helpful in the commission of a crime.2 The category encompasses a wide variety of activities: pro-viding bombmaking instructions,3 holding seminars on how to commit tax fraud,4 exposing the identities of undercover agents,5 publishing the names of crime victims6 or witnesses,7 distributing maps of municipal water supply systems, and even flashing one’s headlights to alert other drivers to a speed trap."

STATE OF TENNESSEE v. BOBBY CRUTCHER - This is an appeal by the State of Tennessee from the judgment of the intermediate appellate court affirming the suppression of evidence in the trial court below.[1] The sole issue is whether the warrantless police search of the appellee’s motorcycle violated his rights guaranteed by the Fourth Amendment of the United States Constitution and Article I, section 7 of the Tennessee Constitution. The State contends that the suppression of evidence was improper because the search in question was incident to a lawful arrest. For the reasons that follow, we conclude that the appellee, Bobby Crutcher, was not under arrest at the time of the police search. Accordingly, we affirm both the trial court and the Court of Criminal Appeal’s determination that the search was not incident to a lawful arrest. The evidence obtained from the search was properly suppressed. On October 19, 1995, Officer Frank Moniz of the Gallatin Police Department observed three motorcyclists drive away from a traffic light at an excessive rate of speed. The officer activated his emergency flashing equipment and pulled over two of the speeding motorcyclists. However, the third motorcycle, driven by the appellee, accelerated even more in an attempt to flee from the pursuing officer. Officer Moniz gave chase to the appellee and the two vehicles reached speeds of one hundred (100) miles per hour. April 12, 1999

NASCAR driver apologizes for being a man

Kyle 'Wild Thing' Busch on Speeding Bust -- 'I Got Carried Away'

Kyle Busch just issued a sort-of apology for his 128 mph speeding ticket -- chalking up his ridiculous speed to a test drive gone wrong, and the blatantly obvious ... "I got carried away."

In his statement Busch says , "I was test driving a new sports car and I got carried away. I went beyond the speed I should have been going on a public road. I apologize to the public, my fans, sponsors, and race teams for my lack of judgment."

The NASCAR bad boy was driving a Lexus LFA when cops in Troutman, NC pulled him over today ... doing 128 mph in a 45 mph zone. BTW ... the LFA packs about 552 horses!

Busch added, "I take responsibility for my actions and I can assure you that something like this will never happen again."

According to cops, Busch was targeted by a special unit called the "Aggressive Criminal Enforcement Team" of the Iredell County Sheriff's Dept.

If convicted, Busch can lose his license for up to a year and face $1,000 in fines.

FAST FACT: NASCAR drivers do not need a valid driver's license ... only a NASCAR license. So, Kyle -- currently 3rd in Sprint Cup points -- is not in jeopardy of getting yanked out of his #18 ride.

NC officials: Kyle Busch speeding at 128 mph

NASCAR driver Kyle Busch was clocked by a North Carolina sheriff's deputy going 128 mph in a 45 mph zone and was cited for careless and reckless driving and speeding, a law enforcement spokesman said Tuesday.

Iredell County Sheriff's Office Capt. Darren Campbell said a deputy stopped Busch's 2012 yellow Lexus sports car on a road between Troutman and Mooresville, where the 26-year-old driver lives. It's about 30 miles north of Charlotte.

Campbell said Busch was cited and released upon a written promise to appear in court.

In a statement issued late Tuesday, Busch acknowledged what happened.

"I was test-driving a new sports car and I got carried away," Busch said. "I went beyond the speed I should have been going on a public road. I apologize to the public, my fans, sponsors, and race teams for my lack of judgment."

Busch, who drives for Joe Gibbs Racing, accepted responsibility and said it would never happen again.

NASCAR spokesman Kerry Tharp said Busch would be allowed to race this weekend at Charlotte Motor Speedway. He's coming off a second-place finish in Saturday night's All-Star race, and goes into the Coca-Cola 600 ranked third in the Sprint Cup Series standings.

"This is a matter that Kyle will have to handle with the authorities in Iredell County," Tharp said. "Based on what we know right now, this would not impact his status as a NASCAR driver."

In 2006, Busch pleaded guilty to improper driving and was fined $150 after he was ticketed in suburban Richmond, Va., on a reckless driving charge when he pulled out of a gas station and into a fast-food restaurant. Busch said at the time he "chirped" his tires but didn't exceed 10 mph.

Under a misdemeanor reckless driving charge he originally faced, Busch could have received up to one year in jail, a $2,500 fine and a driver's license suspension.

Last month, Busch was placed on probation through June 15 after he and Kevin Harvick confronted each other in the pits after a race at Darlington Raceway.

Machete vs Sons of Anarchy

Race war rehab for Atzlan in Charming

Danny Trejo Cast in ‘Sons of Anarchy’ Season 4

In what should be called perfect casting, FX Network’s hit outlaw-biker drama ‘Sons of Anarchy’ has brought film star Danny Trejo on for several episodes during season 4 this fall.

As season 4 rapidly approaches, FX has recruited the ubiquitous Danny Trejo for a multi-episode arc alongside the members of SAMCRO on the biker drama Sons of Anarchy.

Trejo is set to portray former Mexican military commando Romero ‘Romeo’ Parada, who finds himself a new friend in SAMCRO. As with most roles in Sons of Anarchy, the part calls for someone who is capable of intimidating even the toughest of adversaries.

Hitting the road with the motorcycle club is no easy task; not every actor has what it takes to convincingly pull off the biker look and swagger. In this instance, however, the opposite may be true. Trejo could be so convincing he’ll end up intimidating the rest of the cast. In fact, Trejo is so capable of instilling fear that even his recent guest appearances on Modern Family and Bones were filled with a wee bit of trepidation on my part.

Whether he’s is playing the good guy, the bad guy – or a conflicted amalgam of the two – Trejo’s career has been built on the assumption that he is literally the most dangerous guy in the room.

A favorite of Robert Rodriguez, the actor has appeared in almost all of the director’s films including Desperado, From Dusk Till Dawn, and the Spy Kids franchise. Trejo even starred in last year’s Grindhouse offshoot Machete, which reunited him with his Heat co-star Robert De Niro.

Although we have a description of the character Trejo will be playing, we don’t yet know where Romeo Parada is going to fit in. In fact, much of season 4 will be spent finding out where the boys of the outlaw motorcycle club fit in as well.

Sons of Anarchy creator and showrunner Kurt Sutter has said that after the events of season 3, the biggest adversary SAMCRO will face in season 4 will be modernity.

“It’ll be a different Charming. There will be a new mayor and a new sheriff. The 21st century is going to land at SAMCRO’s doorstep. It’ll be interesting, because the 21st century will also bleed into their lives.”

With luck, Trejo will be integral to the storyline in season 4 and thereby enjoy a solid amount of screen time. Sons of Anarchy has had its fair share of actors willing to take a turn on the dark side – some have been obvious choices like Henry Rollins, while others like Adam Arkin and Hal Holbrook were unexpected pleasures. Like Rollins, the announcement of Trejo’s involvement seems like a match made in heaven. Frankly, one can hardly believe it took this long to happen.

Larry Pegram's Superbike Family marathon on HDTheater

Pegram Racing News

Discovery HD Theater will air 6 episodes of “Superbike Family” beginning today at 10 am Eastern Time. If you missed them before make sure you set your DVR or Tivo.

At Infineon Raceway last weekend, Pegram hinted that the future of the show is dependent on the number of viewers it gets and the feedback HD Theater receives on the show.

The series depicts Larry Pegram and his family-based racing team as they compete on the AMA Superbike circuit.

Pegram, a career professional motorcycle for the last twenty years juggles his time managing the most successful independent Superbike team on the circuit while at the same time raising two young girls with his wife Heather. His dad Jim works full-time at the team shop, while his mother tends to the books and feeds the crew on weekends.

“The show is about my dream of becoming a Superbike Champion. Actually, it’s our dream. My parents have been helping me race motorcycles since I was a kid and they’re still here at every race working on the crew. My mechanics are the best and are so committed to this team. They do as much if not more than teams who have twice the manpower. We even have sponsors that after writing the check, help out on the weekends working in the pits. It’s definitely a family effort and we’re real proud of what we have accomplished going up against the factory teams. It’s not easy but all of us are chasing our dream.”

Jew governor signs bill authorizing false flag terrorism

"The FBI has issued a BOLO on suspected terrorists driving a white delivery van from New York City to the Mexican border. The suspects are using Israeli passports. They are armed and dangerous."
-Knox County TN Emergency 911 Dispatch, Sept 11, 2001, 11am EST

Tennessee anti-terrorist bill headed to governor

Nashville, Tenn (AP) -- A secret bill that increases penalties for supporting a patsy terrorist organization is headed to Tennessee Gov. Bill Haslam for his rubber stamp.

"This is a great diversion opportunity for my daddy to loot the $30-billion budget to expand Pilot Oil," Haslam announced. "$10-billion in CAFR pension funds and profitible assets aren't listed in the Budget Report. Sheep don't read the CAFR."

Campaign contributions from ADL lobbyists ensured the measure passed the Senate 26-3, a day after the House version was approved 76-16. No legislators were actually present during the roll call vote on Saturday.

The current measure would allow the governor and the attorney general to label anyone as a terrorist if investigations from the state Department of Homeland Safety as well as the Office of Fatherland Security suggest they are enough of a threat.

The 15-page Material Support for Operation Northwoods Act of 2011 would ultimately fight “homegrown terrorism,” whether the state finds that threat in gangs, cults, religious groups or individuals, according to local gropenfuhrers.

The proposal is an almost Constitutional version of a bill that originally sought to make it a felony to follow some versions of the Islamic code known as Shariah, that forbids banks charging interest and requires wives to have sex with their husbands.

It was later stripped of references to specific religions, for fear it outlawed kosher pedophilia in Talmudic law.

The measure would also no longer authorize the glorious leader nor his lawyer to decide whether a person or group is a terrorist organization, leaving that authority with the psychopathic federal government that burned down Atlanta and carried out the 9/11 attacks.

Republican Senate Sponsor Wild Bill Ketron of Murfreesboro said the proposal targets "home grown terrorist in our country, including Christians, homeschoolers, gun owners, drug dealers, wife beaters, and everyone who says the word 'Constitution'."

Tennessee Highway Patrol and local police are now authorized to rob motorists at gunpoint under "National Security". No trial will be allowed, only body cavity searches, waterboarding or electrodes clipped to genitals.

"Obama Bin Laden is dead," Abe Foxman said. "We don't need no stinkin trials in the War on Goyim. Hell, we made Christianity a felony in Israel, and only jews get citizenship, you dumb schmucks!"

“It’s un-American as far as I’m concerned,” said Rep. Mike Stewart. “What we’re saying here is that somebody in Tennessee, a regular person, can be declared a terrorist, and they have no right to a trial of their peers to clear their good name. That’s just completely the opposite of what we should be doing in this country.”

Mr. Stewart was promptly arrested, frog-marched to the red-light district next door to the Capitol, shot in the head and tossed in a dumpster.

Wall Street jews and Knoxville's Pilot set all gas prices on planet Earth, actual cost to produce is 4-cents a gallon

Six Degrees of Mahmoud Ahmadenijad

"Our next Governor" Mike McWherter's campaign had a bombshell of an announcement today in their effort to shine a little light on Bill Haslam. It appears that in addition to single-handedly leading the effort to price-gouge defenseless old women who needed gas to go see their grand-children, Mr. Haslam also has deep ties to Mad Mahmoud Ahmadenijad. Here is a disturbing graphic to illustrate this connection:

You see, its all rather simple. Bill Haslam, along with the rest of his family, own stock in Pilot Corporation, the company Papa Haslam set up a few decades ago to sell cigarettes, booze and porn to little kids all across America. A few years back, Pilot sold some shares of the company to CVC Capital Partners, a global private equity firm. CVC also holds shares in a chemical company called Evonik, a global company which specializes in chemicals and energy. Evonik openly admits that they have done business in Iran, even boasting about it:

Evonik is a global market and technology leader in DL-methionine, an essential amino acid for healthy and environment-friendly nutrition of livestock, especially poultry. Growth drivers of this attractive market are the rapidly growing young middle-class and industrialization of local meat production. The main markets are Iran, Saudi Arabia, Egypt and Morocco.

FBI will pay you $1-million to arrest American Jewish ADL Al Qaeda spokesman Adam Gadahn Perlman

"The FBI added Adam Gadahn to the Most Wanted Terrorist list and the U.S. State Department is offering a reward up to $1 million for his arrest. A 28-year-old California man has been indicted on federal charges of treason and providing material support to a terrorist group for making a series of propaganda videotapes for al Qaeda, including one in which he praised the hijackers involved in the 9/11 attacks. 'Adam Gadahn represents a new breed of home-grown extremist, who has chosen to betray the country of his birth,' FBI Executive Assistant Director Willie Hulon said during a press conference Wednesday in Washington, D.C."
