Formerly titled the Federal Aviation Administration Authorization Act (FAAA Act). Any fee over $500 is a felony theft under TN Code, and can be prosecuted through a county grand jury, a county judicial commissioner, a county criminal court judge, or by citizens arrest. Example of Affidavit of Probable Cause for Criminal Complaint for cartheft by towtruck.
Any person can file criminal charges against any other person, or make a citizens arrest.
1. Go to a state grand jury without a prosecutor and file an Affidavit of Probable Cause for Criminal Complaint, and the grand jury can issue a presentment (not an indictment).
2. Go to a state judicial commissioner or court clerk (no requirement to be a lawyer) and file an Affidavit of Probable Cause for Criminal Complaint seeking an arrest warrant.

5. Go to a U.S. prosecutor and file an Affidavit of Probable Cause for Criminal Complaint. Fed prosecutors allege they can block citizens from appearing alone before a fed grand jury.
6. Appear before any fed judge and file an Affidavit of Probable Cause for Criminal Complaint seeking an arrest warrant. If a judge refuses to issue an arrest warrant he can file an appeal, all the way to the US Supreme Court if required.
A victim can also sue a civil action in state or federal court. Often it is mandatory to file an administrative claim, before getting a "right to sue letter" denying the claim. This is basically an insurance claim, since govt don't buy no stunkin insurance and "self insures".
An administrative claim for damages is filed with the State of Tennessee Claims Commission, against TN Highway Patrol and its wrecker contractor.

XIV. Towing and Storage Rates and Liability for Payment:
A. The Department shall not establish towing rates. However, towing rates
shall be competitive with the towing rates of certified towing companies in
the same zone. Rates must be reasonable, fair and equitable to all persons
whose vehicles are towed at the request of the Department.
B. Towing and Storage Rate Guidelines:
1. A towing company shall begin charging its towing rate upon arrival “at scene”, unless called out-of-zone; then the towing company shall begin charging its towing rate at the time it is called by the THP dispatcher.
2. Storage rates begin twenty-four (24) hours after a vehicle is towed.
3. Towing companies that happen upon a scene where their services are required shall assist without charge when the roadway is blocked or there is an immediate safety risk.
4. There will be no charge for “hook up”.
5. When towing vehicles are required to wait at the scene for functions to be performed by other emergency personnel, a rate of one-half (1/2) of the normal hourly winching rate shall be charged by the towing company. This rate shall not be exceeded.
6. There shall be no charge for a normal highway clean up. A normal cleanup includes, but is not limited to, removal of glass, vehicle body parts, vehicle fluids, etc. Cleanups requiring additional/specialized equipment and/or resources, such as diesel
spills, Haz-mat, etc. will result in additional charges being levied against the liable party(s) by the towing companies and/or other state regulatory agencies.
7. There shall be no charge for certain types of equipment, e.g., dollies and fire extinguishers.
8. Rates for unloading/loading of cargo will be assessed to the nearest quarter (1/4) hour.
9. An assisting towing company’s rates will be the same or less than the rates of the towing company that requested the assistance.
10. If the off-loading of cargo is required, each towing company providing these services shall list the names, home addresses, and telephone numbers of each person hired to off-load cargo. This list shall be provided to the District Wrecker Lieutenant upon request.
11. An itemized invoice shall be prepared for all charges over one thousand dollars ($1,000). A copy of the invoice shall be given to the owner/designee, and a copy shall be kept on file with the towing company.
C. Liability for Payment of Fees/Charges for, or Associated with, the Removal, Recovery, Towing or Storage of Vehicles:
1. There are many reasons that may cause a vehicle to be towed by a Member of the Department. Each vehicle towed will incur expenses associated with its removal by a towing company. For purposes of inclusion on the THP Rotating Schedule Towing List,
towing companies must agree to the following regulations regarding the payment of removal, recovery, towing or storage of vehicles:
a. The Department shall not be responsible for any fee/charge associated with the removal, recovery, towing, or storage of a vehicle except in cases where the vehicle is seized.
b. In seizure cases, the Department will only pay storage up to the amount that would be obtained from auctioning or selling the vehicle.
XV. Complaints, Investigations and District Captain’s Determination:
A. A towing company that violates any part of this Manual may be removed permanently or suspended from participating on the Towing List for a period of time to be determined by the Department.
B. If the Department becomes aware of any violation of the provisions of this Manual, the District Wrecker Lieutenant shall investigate the alleged violation as set forth herein.
C. The owner of a vehicle towed by a towing company may file a written complaint to the District Captain/designee having jurisdiction in the area where the vehicle was towed if the owner believes that:
1. The towing company towed a vehicle without the owner’s or law enforcement’s authorization; and/or
2. Charged an excessive towing/storage/other services rate; and/or
3. Violated any part of this Manual.
D. All complaints filed pursuant to this Section shall contain:
1. The name of the complainant;
2. The complainant’s address;
3. The complainant’s phone number(s) and e-mail address (if available);
4. The time(s) and manner(s) in which the complainant may be contacted;
5. The name of the towing company;
6. The cause(s) of the complaint;
7. Copies of any documents received from or correspondence with the towing company;
8. The names and phone numbers of any witnesses; and
9. Any other facts that may assist the Department in investigating the complaint.
E. The District Wrecker Lieutenant shall conduct an investigation and shall make an investigatory report with supporting documentation to the District Captain.
F. The District Captain shall review the investigatory report and supporting documentation and shall render a decision. A copy of the complaint, investigative reports, and the decision will be forwarded to the Field Bureau Lieutenant Colonel’s Office.
G. If the investigation reveals that the towing company towed the vehicle without the proper authorization and/or charged excessive rates, the District Captain shall resolve the matter by:
1. Ordering the towing company to promptly reimburse the complainant any monies paid; or
2. Ordering the towing company to release the vehicle with no charge or for an amount determined by the District Captain.
H. In addition to the action taken in Paragraph F, any valid complaint shall result in the towing company’s suspension/removal from the Towing List for a period of time determined by the District Captain. The towing company shall be notified, in writing by certified mail, by the District Captain.
I. The District Captain shall notify the complainant and the towing company, in writing by certified mail, of the District Captain’s determination. Both the complainant and the towing company may appeal from the District Captain’s determination by using the procedures set forth in Section XVI of this Manual.
J. Two (2) or more sustained complaints against a towing company shall result in the removal of the towing company from the Towing List for a period of time, including permanent removal, determined by the District Captain. The towing company shall be notified of the removal, in writing, by the District Captain.

The feds will mandate next month that all new cars be fitted with a black box, according to news reports. So-called black boxes record information about speed, seat belt use and brake application.
The National Highway Traffic Safety Administration has been involved in the use of black boxes since their introduction. In 2006, the safety administration encouraged but did not require automobile manufacturers to install the systems and also did not set a single standard for the way data would be recorded, according to the New York Times.
In February, NHTSA administrator David Strickland said the government was considering making the technology mandatory in the wake of recalls of millions of innocent Toyota vehicles, before the White House nuked Japan. Strickland made the disclosure to a subcommittee hearing by the House Committee on Energy and Commerce.
Now they will make the installation of these device mandatory under federal law. If we are to gauge the reaction of the corporate media, this story is not very important. Outside of industry and technology publications, the story was not reported.

Another thing that will happen as a result of the spying-automobile-electronics-revolution is the growth of aftermarket ECU’s and modified flash memory chips which will allow the owner to modify / erase and reprogram their cars to run without these intrusive features – particularly the pinging of the car’s location / GPS. Many aftermarket auto & motorcycle manufacturers already have hand held programmers that can reprogram the ECU’s code in the computer for drivetrain performance gains. Eventually, the features will include the ability to turn off the black box recorder etc.

BOBBY CRUTCHER - This is an appeal by the State of Tennessee from the judgment of the intermediate appellate court affirming the suppression of evidence in the trial court below.[1] The sole issue is whether the warrantless police search of the appellee’s motorcycle violated his rights guaranteed by the Fourth Amendment of the United States Constitution and Article I, section 7 of the Tennessee Constitution. The State contends that the suppression of evidence was improper because the search in question was incident to a lawful arrest. For the reasons that follow, we conclude that the appellee, Bobby Crutcher, was not under arrest at the time of the police search. Accordingly, we affirm both the trial court and the Court of Criminal Appeal’s determination that the search was not incident to a lawful arrest. The evidence obtained from the search was properly suppressed. On October 19, 1995, Officer Frank Moniz of the Gallatin Police Department observed three motorcyclists drive away from a traffic light at an excessive rate of speed. The officer activated his emergency flashing equipment and pulled over two of the speeding motorcyclists. However, the third motorcycle, driven by the appellee, accelerated even more in an attempt to flee from the pursuing officer. Kyle 'Wild Thing' Busch on Speeding Bust -- 'I Got Carried Away'
Kyle Busch just issued a sort-of apology for his 128 mph speeding ticket -- chalking up his ridiculous speed to a test drive gone wrong, and the blatantly obvious ... "I got carried away."
In his statement Busch says , "I was test driving a new sports car and I got carried away. I went beyond the speed I should have been going on a public road. I apologize to the public, my fans, sponsors, and race teams for my lack of judgment."
The NASCAR bad boy was driving a Lexus LFA when cops in Troutman, NC pulled him over today ... doing 128 mph in a 45 mph zone. BTW ... the LFA packs about 552 horses!
Busch added, "I take responsibility for my actions and I can assure you that something like this will never happen again."
According to cops, Busch was targeted by a special unit called the "Aggressive Criminal Enforcement Team" of the Iredell County Sheriff's Dept.
If convicted, Busch can lose his license for up to a year and face $1,000 in fines.
FAST FACT: NASCAR drivers do not need a valid driver's license ... only a NASCAR license. So, Kyle -- currently 3rd in Sprint Cup points -- is not in jeopardy of getting yanked out of his #18 ride.
NC officials: Kyle Busch speeding at 128 mph
NASCAR driver Kyle Busch was clocked by a North Carolina sheriff's deputy going 128 mph in a 45 mph zone and was cited for careless and reckless driving and speeding, a law enforcement spokesman said Tuesday.
Iredell County Sheriff's Office Capt. Darren Campbell said a deputy stopped Busch's 2012 yellow Lexus sports car on a road between Troutman and Mooresville, where the 26-year-old driver lives. It's about 30 miles north of Charlotte.
Campbell said Busch was cited and released upon a written promise to appear in court.
In a statement issued late Tuesday, Busch acknowledged what happened.
"I was test-driving a new sports car and I got carried away," Busch said. "I went beyond the speed I should have been going on a public road. I apologize to the public, my fans, sponsors, and race teams for my lack of judgment."
Busch, who drives for Joe Gibbs Racing, accepted responsibility and said it would never happen again.
NASCAR spokesman Kerry Tharp said Busch would be allowed to race this weekend at Charlotte Motor Speedway. He's coming off a second-place finish in Saturday night's All-Star race, and goes into the Coca-Cola 600 ranked third in the Sprint Cup Series standings.
"This is a matter that Kyle will have to handle with the authorities in Iredell County," Tharp said. "Based on what we know right now, this would not impact his status as a NASCAR driver."
In 2006, Busch pleaded guilty to improper driving and was fined $150 after he was ticketed in suburban Richmond, Va., on a reckless driving charge when he pulled out of a gas station and into a fast-food restaurant. Busch said at the time he "chirped" his tires but didn't exceed 10 mph.
Under a misdemeanor reckless driving charge he originally faced, Busch could have received up to one year in jail, a $2,500 fine and a driver's license suspension.
Last month, Busch was placed on probation through June 15 after he and Kevin Harvick confronted each other in the pits after a race at Darlington Raceway.

Danny Trejo Cast in ‘Sons of Anarchy’ Season 4
In what should be called perfect casting, FX Network’s hit outlaw-biker drama ‘Sons of Anarchy’ has brought film star Danny Trejo on for several episodes during season 4 this fall.
As season 4 rapidly approaches, FX has recruited the ubiquitous Danny Trejo for a multi-episode arc alongside the members of SAMCRO on the biker drama Sons of Anarchy.
Trejo is set to portray former Mexican military commando Romero ‘Romeo’ Parada, who finds himself a new friend in SAMCRO. As with most roles in Sons of Anarchy, the part calls for someone who is capable of intimidating even the toughest of adversaries.
Hitting the road with the motorcycle club is no easy task; not every actor has what it takes to convincingly pull off the biker look and swagger. In this instance, however, the opposite may be true. Trejo could be so convincing he’ll end up intimidating the rest of the cast. In fact, Trejo is so capable of instilling fear that even his recent guest appearances on Modern Family and Bones were filled with a wee bit of trepidation on my part.
Whether he’s is playing the good guy, the bad guy – or a conflicted amalgam of the two – Trejo’s career has been built on the assumption that he is literally the most dangerous guy in the room.
A favorite of Robert Rodriguez, the actor has appeared in almost all of the director’s films including Desperado, From Dusk Till Dawn, and the Spy Kids franchise. Trejo even starred in last year’s Grindhouse offshoot Machete, which reunited him with his Heat co-star Robert De Niro.
Although we have a description of the character Trejo will be playing, we don’t yet know where Romeo Parada is going to fit in. In fact, much of season 4 will be spent finding out where the boys of the outlaw motorcycle club fit in as well.
Sons of Anarchy creator and showrunner Kurt Sutter has said that after the events of season 3, the biggest adversary SAMCRO will face in season 4 will be modernity.
“It’ll be a different Charming. There will be a new mayor and a new sheriff. The 21st century is going to land at SAMCRO’s doorstep. It’ll be interesting, because the 21st century will also bleed into their lives.”
With luck, Trejo will be integral to the storyline in season 4 and thereby enjoy a solid amount of screen time. Sons of Anarchy has had its fair share of actors willing to take a turn on the dark side – some have been obvious choices like Henry Rollins, while others like Adam Arkin and Hal Holbrook were unexpected pleasures. Like Rollins, the announcement of Trejo’s involvement seems like a match made in heaven. Frankly, one can hardly believe it took this long to happen.
